These Terms & Conditions ("Terms") govern your use of CannaiQ (the "Service"), operated by CannaiQ ("we," "our," or "us"). By accessing or using the Service, you agree to be bound by these Terms.
1. Eligibility
You must be at least 21 years of age to use the Service. By creating an account, you represent that you are at least 21 and have the legal authority to enter into these Terms on behalf of yourself or your organization.
2. Account Registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate and complete information during registration and to update it as needed. We reserve the right to suspend or terminate accounts that violate these Terms.
3. Service Description
CannaiQ provides cannabis shelf intelligence across the United States, Canada, and Puerto Rico. The Service includes competitive analysis, shelf presence tracking, pricing benchmarks, and related analytics tools. Market intelligence is derived from proprietary data collection methods and is provided for informational and business intelligence purposes.
4. Subscription and Payment
Paid features require a subscription. By subscribing, you authorize us to charge the payment method on file at the applicable rate. Subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period. Refunds are not provided for partial billing periods.
5. Acceptable Use
You agree not to: resell, redistribute, or sublicense the Service or its data without our written consent; use automated tools to scrape, crawl, or extract data from the Service beyond normal use; attempt to gain unauthorized access to our systems or other users' accounts; use the Service for any purpose that violates applicable law; or misrepresent your identity or affiliation when creating an account.
6. Data Accuracy
CannaiQ provides market intelligence derived from proprietary data collection methods. While we strive for accuracy and timeliness, we do not guarantee that all data is complete, current, or error-free. Market intelligence is provided for informational and business intelligence purposes and should not be the sole basis for business decisions. We are not responsible for decisions made based on information provided through the Service.
7. Intellectual Property
The Service, including its design, code, analytics methodologies, and proprietary data models, is the intellectual property of CannaiQ. You retain ownership of any data you provide to us. We retain ownership of all aggregated market intelligence, analytics outputs, and derived insights produced by the Service.
8. Limitation of Liability
To the maximum extent permitted by law, CannaiQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim arising from these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless CannaiQ and its officers, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
10. Modifications
We may modify these Terms at any time. Material changes will be communicated via email or through the Service. Continued use after modifications constitutes acceptance of the updated Terms.
11. Termination
We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including limitations of liability and indemnification) will remain in effect.
12. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Maricopa County, Arizona.
